Development – Terms and Conditions
WEBSITE DESIGN & DEVELOPMENT TERMS AND CONDITIONS
1. Scope of Work
The Service Provider agrees to design and develop a website according to the agreed project scope, quotation, or proposal.
2. Client Responsibilities
The Client agrees to provide:
- Required content
- Images and branding material
- Feedback and approvals
- Access to necessary accounts
Delays in providing information may affect project timelines.
3. Project Timeline
Estimated timelines are provided as guidelines and may change depending on revisions, feedback delays, or technical issues.
4. Revisions
The project includes a reasonable number of revisions as agreed in writing. Additional revisions outside the agreed scope may incur additional charges.
5. Payment Terms
- A deposit is required before work begins.
- Remaining balances are payable according to agreed milestones or before website launch.
- Late payments may delay project completion.
6. Ownership & Intellectual Property
The Client will own the completed website upon full payment.
The Service Provider retains ownership of:
- Pre-existing tools
- Frameworks
- Templates
- Custom systems not specifically developed for the Client
7. Third-Party Services
The Client is responsible for costs relating to:
- Domains
- Hosting
- Premium plugins
- Stock images
- Third-party software licenses
8. Browser Compatibility
The website will be developed to function on modern supported browsers. Minor visual differences between browsers and devices may occur.
9. SEO
Basic SEO setup may be included where agreed, but the Service Provider does not guarantee search engine rankings or traffic results.
10. Delays & Abandonment
If the Client becomes unresponsive for more than 30 days, the project may be considered abandoned and additional restart fees may apply.
11. Liability Limitation
The Service Provider shall not be liable for:
- Business losses
- Website downtime
- Security breaches
- Third-party plugin failures
- Search engine ranking losses
12. Portfolio Rights
The Service Provider may display completed work in their portfolio unless otherwise agreed in writing.
13. Governing Law
This agreement shall be governed by the laws of South Africa.

WEBSITE HOSTING & DOMAIN MANAGEMENT TERMS AND CONDITIONS
1. Services Provided
The Service Provider agrees to provide website hosting, server management, domain registration, domain renewals, DNS management, email setup, backups, and related technical support services for the Client.
2. Hosting Environment
The Client’s website will be hosted on the Service Provider’s server infrastructure or reseller hosting environment. The Service Provider will make reasonable efforts to maintain uptime and server stability but does not guarantee uninterrupted service.
3. Domain Management
The Service Provider may register, transfer, renew, or manage domain names on behalf of the Client.
- Domains remain the property of the Client once fully paid.
- The Client is responsible for ensuring domain renewal fees are paid on time.
- Failure to pay renewal fees may result in domain suspension or loss.
- The Service Provider is not responsible for domains lost due to non-payment or incorrect information supplied by the Client.
4. Payment Terms
- Hosting and domain services are billed monthly or annually.
- All invoices must be paid by the due date.
- Late payments may result in suspension or termination of services.
- Fees paid are non-refundable unless otherwise agreed in writing.
5. Backups
The Service Provider may perform routine backups but does not guarantee backup availability. The Client remains responsible for maintaining their own copies of important data.
6. Website Content
The Client is solely responsible for all website content, including legality, copyright, trademarks, and compliance with applicable laws.
The Client may not host or distribute:
- Illegal content
- Malware or harmful software
- Spam-related content
- Copyright-infringing material
- Adult or prohibited content where unlawful
7. Technical Support
Support includes reasonable assistance relating to:
- Hosting issues
- Email setup
- Domain configuration
- Website availability
Support does not include extensive website redesigns, third-party software debugging, or development work unless agreed separately.
8. Suspension or Termination
The Service Provider reserves the right to suspend services if:
- Payments are overdue
- The Client breaches these terms
- The website poses security or legal risks
9. Liability Limitation
The Service Provider shall not be liable for:
- Loss of profits
- Data loss
- Business interruption
- Security breaches caused by third-party software
- Downtime caused by external providers
10. Ownership
The Client retains ownership of their website content and domain upon full payment of all outstanding fees.
11. Cancellation
The Client may cancel services with written notice. Outstanding balances must be settled before files, backups, or domains are transferred.
12. Governing Law
This agreement shall be governed by the laws of South Africa.
